As per the rule's norm, corporates must demonstrate robust physical and cybersecurity measures to qualify for licensing. However, the licensing requisition does not extend to open source AI models like Meta’s Llama. Moreover, supply chain activities like design, manufacturing, and storage of chips remain exempt from this rule.

It's worth noting, however, that countries such as China, Iran, and North Korea, already under an arms embargo, would also experience their first restrictive measure against their access to advanced models apart from advanced chips.

This comes around the time of Donald Trump's inauguration and introduces a 120-day consultation period where inputs will be gathered and modifications made to the rule before enforcing it.

Chip manufacturer Nvidia opposed the new rule, categorizing it as ill-guided and unparalleled. They warned the rule won't enhance U.S. security. Rather, it might undermine America's global competitiveness by hindering innovation.
